Terms of Service

Effective: July 20, 2026

These Terms of Service ("Terms") govern your use of the Lumetia mobile application (the "App"), provided by Xiaofei Ge ("we," "us," or "our"), an individual developer. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent that you are 18 or older.

2. Your Account

You may use certain features without an account. To access cloud sync and other connected features, you must sign in with a Google account. You are responsible for maintaining the security of your account and for all activity that occurs under it.

3. Subscriptions & Purchases

3.1 Plans

The App offers the following plans, billed and managed through Google Play:

• Free — limited access to AI features.
• Pro — monthly or annual subscription with unlimited AI features.
• Lifetime — one-time purchase granting Pro-tier access.

3.2 Google Play Billing

All payments are processed by Google Play. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription in your Google Play account settings. Refund requests are subject to Google Play's refund policies — we do not directly process refunds.

3.3 Nature of License

Free, Pro, and Lifetime plans grant you a non-exclusive, non-transferable, revocable license to use the App's features according to your plan's entitlements. Lifetime refers to the duration of the service — it means Pro-tier access for as long as we continue to operate the App, and does not represent ownership of the software, a perpetual guarantee of service availability, or an obligation on our part to maintain the App indefinitely.

4. AI Features Disclaimer

The App uses large language models (currently via DeepSeek) to generate word definitions, translations, reading passages, and practice exercises. AI-generated content may be inaccurate, incomplete, or misleading. Do not rely on AI outputs as authoritative for critical decisions, academic work, or legal matters. We provide these features as learning aids, not as verified reference tools.

5. User Content & EPUB Uploads

You may upload EPUB files to the App for personal reading. By uploading a file, you represent that:

• You have the right to use and upload that file (e.g., it is in the public domain, you hold the copyright, or you have the copyright holder's permission); and
• Your use of the file through the App does not infringe any third party's intellectual property rights.

We do not claim ownership of your uploaded files. We reserve the right to remove content that we reasonably believe infringes third-party rights.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms
• Attempt to bypass usage limits, subscriptions, or access controls
• Scrape, crawl, or extract data from the App by automated means
• Upload files containing malware, or use the App to distribute spam or unauthorized advertising
• Disrupt, attack, or degrade the App's operation (including denial-of-service attacks)
• Reverse-engineer, decompile, or disassemble the App except as expressly permitted by law

We reserve the right to suspend or terminate access for users who violate these restrictions.

7. Service Changes & Termination

We may update, modify, or discontinue features of the App at any time. For material changes that affect your plan, we will provide reasonable notice through the App or via email. We may suspend or terminate your account if you breach these Terms. Upon termination, your right to use the App ceases immediately.

8. Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Xiaofei Ge and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, learning progress, or subscription value, arising from your use of or inability to use the App. Our total liability for any claim arising under these Terms shall not exceed the amount you have paid us in the 12 months preceding the claim, or USD $10 if you have made no payments.

10. Governing Law

These Terms are governed by the laws of the United States, without regard to its conflict of laws principles. Any disputes arising from these Terms shall be resolved in the courts of the United States.

11. Changes to These Terms

We may modify these Terms from time to time. We will notify you of material changes through the App or via email. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
